These Terms of Service (“Terms”) govern your access to and use of the PatternNexus website, platform tools, content, analytics, user accounts, and related services (collectively, the “Services”). The Services are owned and operated by Christopher Grenke d/b/a “PatternNexus” (“PatternNexus,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1) Eligibility & User Accounts

You must be at least 13 years old to use the Services. To access certain features—such as creating an account, commenting, or subscribing to updates—you may be required to register or authenticate using email, Google, or Facebook. You are responsible for:

• maintaining the confidentiality of your login credentials,
• ensuring the accuracy of information you provide, and
• all activities performed under your account.

2) Acceptable Use

You agree not to misuse the Services, including but not limited to:

• violating any applicable law;
• attempting unauthorized access to accounts, systems, or data;
• engaging in scraping, harvesting, automated data extraction, or similar activity without express permission;
• uploading malware, harmful code, or engaging in phishing, fraud, or spam;
• posting or transmitting illegal, defamatory, abusive, harassing, or infringing content;
• interfering with site performance, security, or the experience of other users.

3) Site Content & Intellectual Property Rights

All articles, research, graphics, charts, data, images, code, branding, and other materials available through the Services are owned by PatternNexus or licensed to us. Content is protected under U.S. and international copyright, trademark, and intellectual property laws.

You may not copy, reproduce, modify, publish, distribute, create derivative works, or commercially exploit content without our prior written permission, except where allowed by fair use or explicit attribution rules defined on the site.

4) User-Generated Content (Comments & Submissions)

When commenting or submitting content (“UGC”), you retain ownership of your contributions. However, by submitting UGC, you grant PatternNexus a non-exclusive, worldwide, royalty-free license to:

• host, store, display, reproduce,
• distribute, publish,
• moderate, remove, or refuse content at our discretion,
• and create derivative works as needed to operate or promote the Services.

You represent that you have the necessary rights to any UGC you submit and that your content does not violate laws or infringe the rights of others.

5) Third-Party Services, Login Providers & External Links

The Services may include links or integrations with third parties, including but not limited to:

• Google (Analytics, AdSense, OAuth login)
• Facebook (OAuth login)
• Cloudflare (security and traffic routing)
• Affiliate partners such as TradingView and Kiavi

We do not control and are not responsible for any third-party content, policies, or practices. Your interactions with third-party platforms are governed by their respective terms and privacy policies.

6) Informational Content Only — No Professional Advice

PatternNexus publishes research, analysis, market commentary, historical interpretation, macroeconomic insights, system models, and educational content. Nothing on the Services constitutes:

• financial or investment advice,
• legal or tax advice,
• professional consulting, or
• any form of fiduciary relationship.

7) Advertising, Affiliate Links & Monetization

The Services may display:

• Google AdSense ads (which use cookies and tracking),
• affiliate links and partner banners,
• external referral links where we may earn a commission when clicked or used to sign up.

8) No Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties—express or implied—including:

• accuracy, completeness, or reliability of information,

• non-infringement,
• availability, uptime, or performance,
• and freedom from viruses or harmful components.

9) Limitation of Liability

To the maximum extent permitted by law, PatternNexus and its owner shall not be liable for any:

• indirect, special, incidental, punitive, or consequential losses;
• loss of profits, revenue, data, or goodwill;
• business interruption or system failures;
• or damages arising from use or inability to use the Services.

Your sole remedy for dissatisfaction with the Services is to stop using them.

10) Indemnification

You agree to indemnify, defend, and hold harmless PatternNexus and its owner from claims, liabilities, damages, losses, and expenses—including reasonable legal fees—arising out of:

• your use of the Services,
• your violation of these Terms,
• or your violation of any law or rights of a third party.

11) Changes to the Services or Terms

We may update or modify the Services or these Terms at any time. When changes are material, the updated Terms will be posted with a new effective date. Continued use after changes constitutes acceptance.

12) Suspension or Termination

We may suspend or terminate your access—temporarily or permanently—at our sole discretion, including for violations of these Terms, illegal activity, security concerns, or service abuse.

13) Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States and the State of Illinois, without regard to conflict-of-law principles. Any dispute arising from or related to the Services shall be resolved exclusively in the state or federal courts located in Illinois.
